VFR Pilot Terms of Use

1. Not an Aviation Instrument — Critical Safety Notice

It is not approved, certified, or endorsed by any aviation authority (including the FAA, EASA, AOPA, or ROMATSA), by Garmin, by the National Weather Service, or by any air navigation service provider.

The watch face is provided solely as a convenience for informational purposes. It is intended to provide convenient situational awareness only and is not intended to satisfy any regulatory or operational requirement for VFR or IFR flight. It must not be used as a primary or secondary source of information for flight planning, pre-flight decision-making, in-flight navigation, weather briefing, or any other operational aviation purpose.

It is not a substitute for official sources such as certified EFBs, official METAR/TAF briefings, NOTAMs, or your aircraft's certified instrumentation.

2. License Grant

Subject to these Terms and payment of the applicable fee, we grant you a personal, non-exclusive, non-transferable license (revocable only as provided in Section 11) to install and use the watch face on a compatible AMOLED Garmin device that you own or control, solely for your personal, non-commercial use.

You may not:

• Reverse engineer, decompile, disassemble, or otherwise attempt to extract the watch face's source code.
• Redistribute, resell, sublicense, rent, lease, or share your license with others.
• Modify or create derivative works of the watch face.
• Use the watch face in any manner that violates Garmin Connect IQ policies or applicable law.

3. Trial Period

The watch face includes a 72-hour full-feature trial beginning with the first installation, allowing you to evaluate all features before purchasing.

After the trial expires, the watch face provides instructions for purchasing a lifetime license.

By installing or using the trial version of the watch face, you agree to these Terms.

4. Purchase, Pricing, and Payment

• The watch face is offered as a one-time purchase at the price displayed during checkout (currently USD $9.99, or the equivalent in your local currency where applicable) for a lifetime license.
• All payments are processed by Paddle.com Market Limited, acting as our authorized reseller and Merchant of Record.
• Your purchase is subject to Paddle's Buyer Terms.
• Paddle is responsible for collecting and remitting applicable VAT, sales tax, or similar indirect taxes where required.
• Every purchase is covered by a 30-day money-back guarantee. Refunds are governed by our separate Refund Policy.

5. Settings and Update Delays

Some changes (such as your selected airport or other settings) may take up to approximately five minutes to appear on the watch face due to Garmin Connect IQ synchronization limitations outside of our control.

6. Third-Party Data Disclaimer

The watch face displays information obtained from third-party services, including AviationWeather.gov (NOAA / National Weather Service) and Sunrise-Sunset.org.

We do not own, operate, control, verify, or guarantee the accuracy, completeness, availability, or timeliness of information provided by these services. They may be delayed, temporarily unavailable, modified, or permanently discontinued at any time.

7. Disclaimer of Warranties

We do not warrant that the watch face will operate without interruption, be error-free, or always display accurate, complete, or current information.

8. Limitation of Liability

Our total cumulative liability for all claims relating to the watch face shall not exceed the amount actually paid by you for the license.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited under applicable Romanian or European Union consumer protection law.

9. Intellectual Property

The watch face, including its software, design, graphics, icons, branding, documentation, and all related intellectual property rights, is owned by or licensed to DIGITXLAB S.R.L. and is protected by applicable copyright, trademark, and other intellectual property laws.

Except for the limited license granted under Section 2, no ownership or intellectual property rights are transferred to you.

10. Platform and Service Dependency

The watch face operates on Garmin's Connect IQ platform and depends on Garmin's continued support of that platform and compatible devices.

We are not responsible for changes, restrictions, service interruptions, discontinuation of the Connect IQ platform, or device compatibility changes made by Garmin.

We do not guarantee that the watch face will remain compatible with future Garmin devices, operating system updates, firmware updates, or Connect IQ platform changes.

The watch face also communicates with our own license-validation service to verify trial and purchase status. While we intend to keep this service available for as long as the watch face is offered, we do not guarantee its uninterrupted or perpetual operation.

We may modify, suspend, or permanently discontinue the watch face or its supporting services at any time. Any such discontinuation will be handled in accordance with Section 11, our Refund Policy, and applicable consumer protection law; beyond what those require, discontinuation of the watch face, its supporting services, or any third-party dependency does not entitle you to a refund or any other remedy.

11. Termination

We may suspend or terminate your license if you materially breach these Terms, including through unauthorized redistribution, reverse engineering, or other misuse of the watch face.

Because the watch face is sold as a one-time lifetime license, any termination for reasons other than your breach will be handled in accordance with our Refund Policy and applicable consumer protection law.

12. Changes to the watch face or These Terms

We may update the watch face and these Terms from time to time.

Where required by applicable law, we will notify users of material changes before they take effect. The latest version of these Terms will always be identified by the Effective Date shown at the top of this document.

13. Export Compliance

You agree not to use, export, or re-export the watch face in violation of applicable export control laws, trade sanctions, or other applicable regulations.

14. Governing Law

These Terms are governed by the laws of Romania, without regard to its conflict-of-law principles.

Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Romania, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.

15. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
